Draft for review. This page was rebuilt from the current site and needs a final check of exact wording before launch.
These Terms of Service (“Terms”) are an agreement between you and Wenmar Pro Inc. (“Wenmar”, “we”). By using Wenmar Pro you accept these Terms. If you don’t agree, please don’t use the service.
1. Definitions
- Services means the Wenmar Pro platform, including app.wenmarpro.com, shop workspaces, customer portals, mobile apps and related services.
- You means the automotive shop or business that creates the account.
- Authorized Users means the employees, technicians, service advisors and contractors you allow to use the Services under your account.
- Customer Data means everything you or your Authorized Users enter into Wenmar Pro, including customer details, vehicle data, work orders, invoices, messages and uploaded files.
- Business Hours means 9:00 a.m. to 5:00 p.m. Eastern Time, Monday to Friday, excluding Canadian statutory holidays we observe.
- Plan means your subscription. Today there is one plan with every feature included, billed monthly.
2. Your account
- You must be 18 or older and able to legally bind your business. Repair shops must hold the licences and insurance their province or territory requires.
- You’re responsible for keeping your account secure, including your Authorized Users’ accounts. Use strong passwords, turn on two-factor authentication, and tell us right away if you suspect someone has unauthorized access.
- You’re responsible for activity under your account, and your Authorized Users must follow these Terms.
- The person who creates the account is the account owner. Contact us to transfer ownership.
3. Acceptable use and messaging
You may not:
- use the Services for anything illegal
- send spam or harassing or abusive messages
- upload viruses, malware or other harmful code
- access accounts or data that aren’t yours
- scrape or data-mine the platform
- interfere with the Services for other users
- reverse engineer the software or try to extract its source code
- make so many API calls that performance suffers for others
- impersonate anyone or misrepresent your identity
- violate anyone’s intellectual property or privacy rights
Text messaging. We send texts through Twilio, and your shop is the sender of every message. You must follow Canada’s Anti-Spam Legislation (CASL), the U.S. Telephone Consumer Protection Act (TCPA) where it applies, and carrier rules, including business texting registration. That means you must:
- get each recipient’s express consent before texting them
- identify your shop in your messages
- honour opt-outs such as STOP right away
- respect time-of-day restrictions on messaging
- provide the business documents carriers require to register your shop
Message and data rates may apply to recipients. Recipients can reply STOP at any time to opt out of non-essential messages.
4. Pricing and billing
Price. Your first 3 months are free with every feature included and no credit card required. After that, Wenmar Pro is $99 CAD per month for one location, with every feature included. There are no setup or onboarding fees. Prices are in Canadian dollars and applicable sales taxes are added.
Founding rate. Starting July 26, 2027, new accounts may choose tiered plans based on bays and features. Accounts activated before then keep the $99 per month rate for as long as they stay active.
Before your first charge. We’ll email you before your free months end. Nothing is charged unless you add a payment method and choose to continue.
Card payments from your customers. Taking payments in Wenmar Pro uses Fiska. Fiska’s processing fees are separate from your subscription and are charged at Fiska’s published rates. By using these features you agree to Fiska’s terms and its payment processor’s agreement, and you must provide accurate business information for identity verification.
Billing. You authorize us to charge your payment method for your subscription. If a payment fails, we’ll let you know and give you a grace period before limiting your account.
Price changes. We’ll give you at least 30 days’ notice by email before any price change to your plan.
5. Cancellation and termination
- How to cancel. Cancel any time in your account settings. You can also email help@wenmarpro.com and we’ll cancel for you.
- What happens next. Cancellation takes effect at the end of your current paid period and you won’t be charged again. See our Refund Policy for when we refund the current period.
- If we end the account. We may suspend or close an account for serious or repeated breaches of these Terms, security risks, illegal activity, non-payment or harassment of our team. Except where there is an urgent risk, we’ll tell you first and give you a chance to fix the problem and export your data.
6. Your data after cancelling
- You can export your Customer Data at any time with the built-in export tools.
- After your paid period ends you have 60 days of read-only access to export it. After that we may permanently delete it. Removing it from backups can take up to 60 more days.
7. Support
Support is available during Business Hours at help@wenmarpro.com. We often reply outside those hours too, but we don’t promise to.
8. Service status
Live system status and incident history are at status.wenmarpro.com.
9. Privacy and where data is stored
We follow PIPEDA. We use personal information only to provide the Services, limit access to people who need it and protect it with reasonable safeguards. Our primary hosting is in Germany, with backups in Canada, and some providers are in the United States. Our Privacy Policy explains this in detail.
10. Automotive rules and licences
- You’re responsible for following Ontario’s Consumer Protection Act and any other provincial rules that apply to auto repair, such as written estimates and authorizations. Wenmar Pro helps with this but is not legal advice.
- You confirm that you and your staff hold the repair licences, permits and insurance your jurisdiction requires.
11. Security and payment card rules
We use TLS encryption, access controls and secure infrastructure. Fiska handles the transmission of card data. You’re responsible for card security outside Wenmar Pro, such as the physical security of your payment terminals.
12. Third-party services and QuickBooks
Fiska, Twilio and QuickBooks Online have their own terms, and we’re not responsible for how they perform. If you connect QuickBooks Online, you authorize us to send your invoices, customers and payments to Intuit on your behalf. You’re responsible for checking that synced data is accurate and that your books reconcile.
13. Ownership
We own the Services and the software. You own your Customer Data and give us permission to use it only to provide the Services. We may use aggregated data that cannot identify you or your customers to improve the Services.
14. Suggestions
If you send us ideas or suggestions, we may use them without paying you. This avoids disputes over features we may already be building.
15. Early access features
Features we label as beta or early access are provided as they are, without warranties, and may change or be removed.
16. Liability
We’re not liable for indirect or consequential losses. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. You agree to cover claims against us that arise from your Customer Data, your use of the Services or the repair work your shop performs. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
17. Disputes and governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be resolved in the courts of Toronto, Ontario. If we start operating in the United States, we’ll publish supplemental terms with 30 days’ notice.
18. Changes to these Terms
If we make a meaningful change, we’ll email account owners at least 30 days before it takes effect. These Terms and our Privacy Policy are the entire agreement between us. Neither of us is responsible for delays caused by events beyond our reasonable control.
